ABSTRACT:
Military service regulations during the Yuan Dynasty formed an important part of the empire’s legal system and were incorporated into the broader framework of state law. The Yuan military organization inherited the decimal system that had characterized the political and military institutions of the Mongols during the early and medieval periods. At the same time, it was further developed in conjunction with the administrative structure, household registration system, and taxation mechanisms of the sedentary Chinese state. According to Yuan legislation, military conscription among the Mongol population was organized on a household basis. The law stipulated that households with two or three male members were required to provide one soldier, those with four or five male members two soldiers, and those with six or seven male members three soldiers. This regulation served as the principal legal basis for recruiting soldiers from Mongol households. In addition, military recruitment and replenishment within the Chinese territories of the Yuan Empire were carried out through the institution of military households. Military households consisted of Mongol families resettled in China as well as the families of soldiers from the former Jin and Song states who had surrendered to the Mongols.
The legal obligations associated with military service were well understood among households that had performed military duties over several generations. Yuan legislation explicitly stipulated that military service must be performed in person and that those who resisted or evaded service would be subject to punishment. In cases where individuals fled due to poverty, responsible officials were required to investigate the circumstances thoroughly. If poverty was found to have been falsely claimed as a pretext for evading military obligations, supervisory authorities were authorized to conduct further investigations.
During the Yuan period, separate registers were maintained for military households, tamachi troops (military units established by the Mongols and stationed in conquered territories), Chinese troops, and substitute military households. Conscription policies were implemented on the basis of each household’s economic condition, labor capacity, and ability to fulfill military obligations. In particular, the system of regular and substitute military households was designed to ensure the continuity of military service and to prevent shortages of military personnel. Military service was hereditary in nature, and the obligation could be transferred not only to male members of the household but also to sons-in-law and other relatives. This legal arrangement demonstrates the importance that the Yuan state attached to maintaining the stability and continuity of military households. The military law of the Yuan Dynasty regulated not only conscription and military service but also military discipline, military offenses, wartime regulations, and relations between military personnel and civilians.

Юань улсын үеийн цэргийн албаны хууль нь цэргийн хуулиндаа багтаж, цэргийн албаны хууль нь бусад хуулиндаа багтдаг байсан байна. Юань улсын цэргийн байгуулал нь аравтын тогтолцоонд суурилсан монголын эрт, дундад үеийн төр, цэргийн зохион байгуулалтыг уламжлан авахдаа хятадын суурин иргэншлийн төрийн захиргаа, хүн амын бүртгэл, татварын тогтолцоотой уялдуулан хөгжүүлсэн юм.
Эрчүүдийг цэргийн албанд татахдаа “Өрх бүр 2-3 эртэй бол нэг хүн, 4-5 эртэй бол 2 хүн, 6-7 эртэй бол 3 хүн” цэрэгт татах хуультай байжээ. Энэ хуулийг монгол айл өрхөөс цэрэг татахдаа баримталж байжээ. Үүний зэрэгцээ хятад газар байсан Юань улсын цэргийн нөхөн хангалтыг цэргийн өрхөөс цэрэг татах аргаар явуулж байжээ. Цэргийн өрх гэдэг нь хятад газар нүүн очсон монгол айл өрх хийгээд эзлэн авсан Алтан улс, Сүн улсын буун өгсөн цэргийн ар гэр юм.
Цэргийн хүн алба хаах хуулийг гурван үеэрээ цэргийн алба хааж буй өрхийн хүмүүс сайн мэддэг байсан.
Юань улсын хуульд зайлшгүй “Өөрийн биеэр алба хаана”, “Зөрчин эсэргүүцэгчид ялтай” хэмээн заасан байдаг. Гэр орон нь ядуугийн улмаас оргон зайлсан тохиолдолд хариуцсан түшмэлийн алба нь зайлшгүй хянан нягтлах шаардлагатай ба хэрвээ хуурамчаар ядуу мэт дүр эсгэсэн бол хяналтын хэлтэс нэмэлт мөрдлөг явуулдаг байв.
Юань улсын үед цэргийн өрх, тамачи цэрэг, хятад цэрэг, нөхвөр цэргийн өрхийн бүртгэлийг тусгайлан хөтөлж, өрхийн хөрөнгө чинээ, хөдөлмөрийн чадвар, алба хаах боломжийг харгалзан цэрэг татах бодлого хэрэгжүүлж байв. Ялангуяа жинхэнэ болон нөхвөр цэргийн өрхийн тогтолцоо нь цэргийн албыг тасралтгүй үргэлжлүүлэх, цэргийн хүний хомсдолоос сэргийлэх зорилготой байжээ. Цэргийн алба нь удам дамжин үргэлжлэх шинжтэй байсан бөгөөд өрхийн эрэгтэй гишүүд, хүргэн, төрөл садны хүмүүс хүртэл цэргийн үүргийг залгамжлан биелүүлэхээр хуульчлагдсан нь төрөөс цэргийн өрхийн тогтвортой байдлыг онцгойлон анхаарч байсныг харуулдаг.
Юань улсын цэргийн хууль нь зөвхөн цэрэг татлага, цэргийн алба хаах асуудлыг зохицуулаад зогсохгүй цэргийн сахилга бат, цэргийн гэмт хэрэг, дайны үеийн журам, цэрэг-иргэний харилцаа зэрэг өргөн хүрээний асуудлыг хамарч байжээ.
